The Linz Public Prosecutor’s Office has opened proceedings over three medical facilities’ refusal to examine a transgender woman named Viola, who sought urgent medical assistance following an alleged rape. The victim wanted to be tested for the presence of drugs in her blood, but the first hospital refused to examine her because there was no urologist available and because of her “male sexual characteristics.” The second hospital referred her to another facility without examining her.
At the third hospital, the woman waited for more than an hour for medical assistance and was not given pain medication, although the facility’s management disputes this account.
Investigators are currently examining the medical staff’s actions and hospital records, while also investigating the case against the alleged rapist, who denies that any sexual contact took place.
